Kekerasan seksual dalam apa jua bentuk mesti ditolak

Lontaran berunsur ugutan dan ancaman untuk melakukan keganasan ke atas YB Rodziah Ismail ketika majlis dialog di antara Kerajaan Negeri Selangor dan penduduk Seksyen 23, Shah Alam oleh mereka yang hilang pertimbangan untuk bersikap terbuka dan beradab dalam sebuah majlis dialog amatlah tidak wajar sama sekali.

Lontaran-lontaran sedemikian merupakan suatu kesalahan menurut undang-undang negara dan berlawanan dengan ketetapan konvensyen mengenai penghapusan sebarang bentuk keganasan terhadap wanita yang telah ditandatangani oleh Kerajaan Malaysia (CEDAW).

Mereka yang bertanggungjawab dan dikenalpasti mengugut-cerca YB Rodziah Ismail mestilah disiasat dan dihukum jika didapati bersalah.

Shah Alam, 11 September 2009 : Hari ini saya membuat laporan polis terhadap ugutan rogol yang dilemparkan kepada saya ketika dalam Majlis Dialog di antara penduduk Seksyen 23, Shah Alam dengan Kerajaan Negeri Selangor pada 5hb September lalu di MBSA, Shah Alam.

Adalah bukan hasrat saya untuk memanjangkan isu ini kerana fokusnya adalah isu sebenar yakni pemindahan kuil Seksyen 19, namun keputusan ini dibuat setelah hampir seminggu berlalu kerana kegusaran tentang keselamatan diri saya, keluarga serta pegawai saya makin hari makin bertambah memandangkan pihak polis belum lagi mengambil sebarang tindakan dalam perkara ini.

Saya telah hadir sebagai salah seorang panel dan wakil rakyat Dun Batu Tiga bagi menyelesaikan isu pemindahan kuil, namun telah menerima kata-kata kesat dan ugutan rogol daripada mereka yang cuba menimbulkan kekecohan dalam majlis tersebut.

Antara kata-kata kesat terhadap saya yang dikenalpasti ialah;

“Jalang!”
“Rodziah mengalahkan pelacur!” “Pelacur lebih baik dari kau!”
“Babi!”
“Sundal!”
“Kau jangan bersuara, Rodziah!”
Lemparan kata,”Aku akan rogol kau, Rozdiah!”

Intimidasi ini jelas adalah untuk memburukkan nama dan menghina saya. Saya berasa amat kecewa dengan sikap yang ditunjukkan oleh segelintir mereka ini sehingga merasakan keselamatan dan kehormatan diri saya terancam.

Kerisauan saya ialah: jika saya seorang Adun dan EXCO Kerajaan Negeri boleh dilemparkan kata-kata kesat and ugutan sebegini, apakah wanita-wanita lain akan terasa selamat menghadapi atau berurusan dengan mereka yang seperti itu?

Kekecohan yang ditimbulkan sepanjang sesi penerangan daripada Dato’ Menteri Besar, Tan Sri Khalid Ibrahim, Ahli Parlimen Shah Alam, Khalid Samad, Dato’ Bandar dan saya sendiri selaku ADUN Batu Tiga juga memperlihatkan sikap tidak hormat kepada majlis tersebut serta pemimpin kerajaan negeri.

Kelakuan liar kumpulan kecil ini telah merosakkan majlis yang bertujuan untuk membuka ruang kepada penduduk berdialog secara berhemah. Tindakan mereka ini jelas bukan untuk berdialog tetapi mencemarkan kerajaan negeri dan nama individu atas agenda politik tertentu.

Selain klip video, ungkapan-ungkapan tidak bermoral itu telah didengar dan disaksikan oleh ramai penduduk, wartawan, dan para petugas keselamatan MBSA yang telah hadir melihat sendiri gelagat segelintir mereka yang memporak-perandakan majlis secara sengaja.

Kedurjanaan yang menganjur keburukan, membudayakan unsur keganasan, seksisme, dan menakut-nakutkan orang lain serta merosakkan keharmonian sesama insan yang telah ditunjukkan oleh golongan tersebut wajar diperangi dan dibanteras sehingga rakyat, khususnya wanita dikembalikan nikmat rasa selamat dan aman di mana-mana saja mereka berada.

Memerangi Budaya Durjana yang Mencabul Hak dan Maruah Wanita

Wanita KEADILAN mengutuk gelagat segelintir penduduk yang telah merosakkan majlis dialog antara penduduk Seksyen 23 dan Kerajaan Negeri Selangor, Darul Ehsan pada 5 September 2009 lalu.

Perlakuan mereka yang tidak tahu malu telah memalukan Malaysia di mata dunia.   Bahkan tindakan dan lemparan kata-kata ancaman dan celupar mereka boleh ditafsirkan sebagai jenayah keganasan seksual terhadap Adun, merangkap Pengerusi Jawatankuasa Tetap Hal Ehwal Wanita,

Kebajikan, Sains, Teknologi, Inovasi dan Kebudayaan Kerajaan Negeri Selangor, Darul Ehsan, Rodziah Ismail yang juga Timbalan Ketua Wanita KEADILAN.

Wanita KEADILAN mengecam sekeras-kerasnya tindakan tidak bertamadun segelintir penduduk dari Seksyen 23 di Majlis Dialog tersebut.   Tindakan mereka bertujuan mencemar maruah Rodziah Ismail secara batil dan menghalang beliau daripada menyampaikan penjelasan yang tepat kepada seluruh wakil penduduk Seksyen 23 mengenai isu perpindahan kuil dari Seksyen 19 ke Seksyen 23.

Wanita KEADILAN menyokong penuh laporan polis yang dibuat oleh Rodziah Ismail dalam memelihara keselamatan beliau dari sebarang ancaman yang telah dilemparkan dan memberi isyarat yang lantang kepada pelaku-pelaku budaya durjana bahawa budaya durjana yang mencabul hak dan maruah wanita Malaysia mesti diperangi habis-habisan.   Pendurjana mesti di bawa ke pengadilan, dihukum  dan tidak mengulangi perbuatan durjana mereka itu.

KUALA LUMPUR: Selangor state executive councillor and Batu Tiga assemblywoman Rodziah Ismail will be lodging a police report today on a rape threat that was made against her during a chaotic dialogue between the Selangor state government and the residents of Section 23 in Shah Alam on Sept 5.

“Anarchist behaviour and hurling profanities are unbecoming of a civilised society. Psychological abuse in whatever form and threats of abuse and sexual molestations must be promptly eliminated,” said Rodziah’s aide, Rozaini Mohd Rosli, in an email statement yesterday.

She said the report would be lodged at the Shah Alam police headquarters in Section 11.

The dialogue session took place amid the Section 23 residents’ protest against the relocation a Hindu temple to their area. Since then, the residents have agreed to the relocation to a second site, also in Section 23.

Six men have been charged with sedition for being part of the cow-head protest against the relocation to the temple. They were also charged with another six men for taking part in an illegal assembly.

LAPORAN PENYIASATAN DAKWAAN PENDERAAN SEKSUAL TERHADAP WANITA KAUM PENAN TIDAK AKAN SELESAI MASALAH

Wanita KEADILAN ingin merakamkan terima kasih kepada Ketua Setiausaha Kementerian Pembangunan Wanita, Keluarga dan Masyarakat, Tan Sri Faizah Md Tahir yang telah menemui dan memberikan kerjasama kepada rombongan Wanita KEADILAN bagi mendapatkan Laporan oleh Jawatankuasa Bertindak Peringkat Kebangsaan bagi Menyiasat Dakwaan Penderaan Seksual Terhadap Wanita Kaum Penan di Sarawak yang diketuai oleh Menteri Pembangunan Wanita, Keluarga dan Masyarakat, Shahrizal Abdul Jalil.

Laporan tersebut telah diperoleh semalam, Selasa 8 September 2009.   Wanita KEADILAN telah dengan serta-merta menghebahkannya kepada seluruh rakyat Malaysia, khususnya kepada aktivis yang membela keadaan kaum Penan di Sarawak.

Penelitian terhadap Laporan tersebut telah mendapati bahawa matlamat untuk menyediakan pelan tindakan menangani secara khusus bagaimana untuk mengelakkan jenayah rogol dan penderaan seksual terhadap wanita, gadis dan anak-anak perempuan kaum Penan dengan sewenangnya dari terus berlaku tidak tercapai.

Laporan tidak menyebut peranan khusus yang harus dimainkan oleh pihak polis di Sarawak dalam pelan tindakan untuk menghentikan pencabulan seksual ke atas wanita dan gadis kaum Penan .

Sikap acuh tak acuh dan tidak mesra kaum Penan Polis Sarawak telah memburukkan lagi keadaan bagi keselamatan kaum Penan, khususnya wanita dan gadis.   Kenyataan Ketua Polis Bahagian Jenayah, ACP Huzir Mohamed bahawa PDRM Sarawak tidak mempunyai peruntukkan untuk misi bersama NGO untuk terus menyiasat dakwaan mengenai kes rogol wanita dan gadis Penan sungguh menghampakan.

Janji Ketua Polis Negara, Tan Sri Musa Hassan kepada Penan Support Group pada 02.01.2009 bahawa PDRM bersetuju untuk mengadakan siasatan bersama dengan bantuan NGO pula belum menghasilkan sebarang tindakan.

Wanita KEADILAN juga kesal bahawa tiada usaha untuk membawa mereka yang bersalah (yang telah dikenalpasti menurut Laporan) melakukan penderaan seksual terhadap anak-anak, yang semuda usia 10 tahun, sehingga ada di antaranya berulang kali hamil dan melahirkan anak, tidak dibawa ke muka pengadilan.

Wanita KEADILAN mengutuk syarikat pembalakan yang telah jelas sama sekali mengabaikan tanggungjawab sosial mereka dalam memelihara cara hidup, maruah dan kesejahteraan kaum Penan.   Perbuatan pekerja syarikat pembalakan yang mencabul kehormatan wanita kaum Penan merupakan suatu kehinaan yang bersifat kehaiwanan.    Malaysia tidak memerlukan syarikat-syarikat sedemikian yang bersifat rakus beroperasi hanya untuk kepentingan material dan keuntungan wang ringgit yang membawa padah kepada rakyat.

Apakah keuntungan berbilion ringgit mereka tidak dapat dikongsi dalam membangunkan infrastruktur dan usaha-usaha menjamin keselamatan kaum Penan di mana mereka membalak?

Six charged with sedition over cow-head protest

Twelve people were today charged for their role in the ‘cow-head’ protest at the Selangor state secretariat on Aug 28.

Of the 12, six were charged under the Sedition Act for allegedly causing racial tensions by displaying and stepping on a cow’s head during the protest.

These six also faced a second charge of illegal assembly with the remaining six.

The first six were charged under Section 4(1) of the Sedition Act, or alternatively under Section 298 of the Penal Code.

They were Ibrahim Sabri, 42, Ahmad Mahayuddin Abd Manaf, 36, Eyzva Ezhar Ramly, 35, Mohd Azmir Mohd Zain, 35, Ahmad Suhairy Zakaria, 39 and Mohd Hilmi Ni, 40.

The first two were charged with stepping on the cow’s head, the third for bringing the animal’s head while the remaining three for both bringing and stepping the cow’s head.

They can be punished up to three years jail and/or a fine of up to RM5,000.

They were part of a larger group of people who took part in the protest against the Selangor government’s decision to relocate a 150-year-old temple from Section 19 to their neighbourhood.

The six defendants claimed trial before Sessions judge Hasbi Hassan.

Deputy public prosecutor Mohd Dusuki Mokhtar asked for bail to be set at RM15,000 each while their lawyers Salehuddin Saidin and Afifudin Ahmad Hafifi wanted it reduced to RM500 each.

Justice Haslin then set bail at RM4,000 each with a guarantor. She also fixed Oct 21 to mention the case for trial.

The second charge

Later, these six and six others were charged with illegal assembly under Section 27(5)(a) of the Police Act at the Shah Alam Magistrate’s Court.

All of the claimed trial before magistrate Norkamilah Aziz.

The six who faced sedition trial was granted bail at RM300 each while bail for six others was set at RM500 each.

The case will also be mentioned on Oct 21.

Meanwhile some 20 residents of Section 23 in Shah Alam were at the court to show support for the 12.

“We are not guilty (of taking part in the protest). We are all united on this matter,” a resident told reporters.

The protest, during which two people had carried a cow’s head and uttered provocative remarks – sparked outrage among Malaysians, who called for action be taken.

After the proceedings, the residents said the bail set for the defendants is too high. They said they will launch a donation drive to raise funds.

‘New site acceptable’

In a related development, a representative of the residents said they have accepted the new relocation site – also in Section 23 – for the temple.

The new site was identified by the state government on Monday after fierce protests by the residents.

The new site is believed to be further away from the houses.

The representative also hoped the temple committee will agree to the new site.

“If the matter is solved, then we hope the Indian brothers who lodged police reports against us will withdraw their reports and this case will be dropped,” added the representative.

The Penan Report

Isu Penan:Kunjung Hormat ke Kementerian Pembangunan Wanita, Keluarga dan Masyarakat

Rombongan Ketua Wanita KEADILAN telah menemui wakil Menteri Pembangunan Wanita, Keluarga & Masyarakat, Tan Sri Faizah binti Mohd Tahir (bawah, kanan sekali).

Beliau telah memenuhi permintaan Wanita KEADILAN untuk menghebahkan laporan jawatankuasa bertindak peringkat kebangsaan bagi menyiasat dakwaan penderaan seksual terhadap wanita kaum Penan di Sarawak.

Penelitian terhadap Laporan tersebut tidak menyebut tentang tindakan susulan yang wajar bagi membawa mereka yang telah melakukan perkara yang terkutuk itu ke muka pengadilan.

Laporan telah menyatakan perkara-perkara berkaitan dengan masalah-masalah ketiadaan sijil kelahiran, pembelajaran murid dan prasarana kesihatan rakyat Penan. Tiada pelan tindakan khusus supaya jenayah rogol dan penderaan seks terhadap wanita dan gadis Penan tidak berulang lagi.

Apa yang ketara ialah PDRM tidak disebut secara fokus sebagai agensi yang bertanggungjawab memastikan keselamatan Kaum Penan.

New site for Hindu temple in Shah Alam

SHAH ALAM: The Selangor Government has identified a new, more suitable site for the relocation of the 150-year-old Sri Maha Mariamman Hindu temple in Section 19 here.

A press statement from the state government said that the new site is still in Section 23 but was more strategic and located 100m from the original relocation site and 400m from the residential area.

The state government would discuss the matter with the temple committee and look for an amicable solution acceptable to all parties, the statement said.

It said that the identification of the new site was the result of the efforts of Batu Tiga assemblyman Rodziah Ismail, Shah Alam MP Khalid Samad, Shah Alam Mayor Mazalan Md Noor and PKNS chairman Othman Omar who checked out suitable sites in Section 18, 19, 20 and 23.

‘Cow-head’ protesters to face charges

Attorney-General Abdul Gani Patail today said that he would be charging those who took part in the ‘cow-head’ protest 10 days ago.

“I have decided to charge those who carried (the cow head) and spoke while stepping on the cow head under Section 4(1) of the Sedition Act, alternatively under Section 298 of the Penal Code,” said Abdul Gani in a statement today.

He added that all the demonstrators will also face another charge under Section 27(5) of the Police Act for illegal assembly. [see below for details of the sections]

He said that the decision was based on the investigation paper submitted by the police to him this afternoon.

“I am satisfied based on the facts and evidence gathered by the police that the demonstrators should be taken to court,” he said.

The investigation paper was the result of a two-week long police investigation into the protest which has put Malaysia on the international stage for the wrong reason after public outcry over the issue.

Abdul Gani however did not state when the charges would be preferred against the demontrators. He also did not reveal the number of people to be charged.

New site identified

On Aug 28, the demonstrators, residents of Shah Alam’s Section 23, marched to the state secretariat to protest the proposed relocation of the Sri Maha Mariamman Hindu temple from nearby Section 19.

They were reportedly unhappy that the 150-year-old temple is to be relocated in the Malay-Muslim majority neighbourhood.

The protest turned sour when several unidentified men came forward with a dismembered cow’s head and placed it in front of the building gates.

Several individuals then proceeded to spit and step upon the animal’s head while uttering threats apparently directed at Selangor executive councillor for health, plantation workers, poverty and caring government Dr Xavier Jayakumar

An attempt by the the state government to hold a dialogue with the residents last Saturday turned rowdly (photo, above) when the residents vehemently objected to the temple being relocated to their neighbourhood.

Following this the state government shelved the plan to relocate the temple but today announced that another site has been found in Section 23 for the relocation.

When herd mentality ruled the day

IF anything coherent came out of Saturday’s dialogue – if you can call it that – on the relocation of a Hindu temple from Section 19 to an industrial zone in Section 23 Shah Alam, it is this: that minority rights and peaceful discourse has lost out to mob rule.

The dialogue was meant for residents of Section 23 but in the end, it was hijacked by a mob determined to disrupt the proceedings.

The 50-odd protesters — made up of residents and non-residents — threatened to throw shoes and a chair at the state representatives which included Mentri Besar Tan Sri Abdul Khalid Ibrahim, Shah Alam MP Khalid Abdul Samad and Batu Tiga assemblyman Rodziah Ismail.

Amid the boos, insults and threats, the Selangor state reps sat through the whole two-hour session held at the banquet hall of the Shah Alam City Council (MBSA) and tried to deal with the hotheads.

This was especially evident when a resident expressed her fears that crime rate would rise if the temple was built in Section 23. In reply, Khalid Abdul Samad countered that this was precisely why a temple was needed so that Indian youth and children could have a place to congregate and where strong religious and moral values could be inculcated.

But his effort seemed futile as the rowdies were intent on disrupting the proceedings even before they stepped into the hall. It is also noted that police were conspicuously absent from the meeting, which at times threatened to turn ugly.

Social planning gone wrong

These loud protests over the temple relocation, however, fail to take into account the larger issue here — that it is a direct consequence of social engineering with poor planning on the part of the Selangor State Development Corporation or PKNS and the Shah Alam local authorities.

Just 50 years ago, large tracts of what is now Shah Alam were plantations. In the late 60s, PKNS started buying land from the Sungai Renggam estate, with a plan to build a township where 60-80% of the residents would be Malays.

As the area developed, many of the temples, some of which were more than a century old, ended up being surrounded by housing estates.

This is what happened to the 150-year-old Sri Maha Mariamman Temple in Section 19. Originally built in a sparsely populated plantation, it slowly found itself surrounded by houses. But the Section 19 house buyers claim the temple was not in the brochure when the housing project was launched, and as such want the temple to be relocated.

Similarly, Section 23 residents are using the same argument — that they would not have bought their property if they knew a temple would be located nearby.

Another key point in the issue is the relocation of a temple to a Muslim-majority area. But where one can find a non-Muslim majority area in Shah Alam?

Nowhere to go?

With nowhere else to go, the only alternative open to the state government is to relocate the temples to industrial areas within the city. But this too is no easy task as it requires that all parties — the temple committee, the MBSA, PKNS and the state government — come to an agreement.

The temple committees are understandably unhappy as sites offered are isolated and not accessible by any form of transportation. Such was the case with the Sri Maha Mariamman Temple committee, which objected to a site in a remote area in Section 22.

Now it is back to the drawing board for those involved to fix a problem which resulted from a lack of foresight by past administrators.

Saturday’s dialogue ended with the mentri besar shelving the proposal to relocate the temple to Section 23. He has also said he will meet with the Hindu community to find a solution.

At the end of the meeting, some residents from both sides of the divide shook hands with each other as they said goodbye, but the underlying tension was evident.

If anything, the encounter has forced some Hindu residents of Section 23 to take a hard look at their neighbours.

One woman said: “We have been close to our neighbours all this while and have looked out for each other, but this incident has shown how our neighbours view us and where we stand.”

Seperti yang dijangkakan, media arusperdana Malaysia akan mengungkapkan pemikiran dan laporan yang dangkal serta berat sebelah, penuh dengan diskriminasi terhadap Kerajaan Negeri Selangor mengenai dialog anjuran Kerajaan Negeri Selangor bersama penduduk Seksyen 23, Shah Alam mengenai isu cadangan perpindahan kuil dari Seksyen 19 ke Sekyen 23, Shah Alam (Opposition “tasting own medicine” oleh Alina Simon, M.Hamzah Jamaluddin dan TN Alagesh, NST 7/09/09, http://www.nst.com.my/Current_News/NST/articles/20090907073422/Article/index_html)

Bagi mereka yang berpemikiran waras, jelas bahawa gelagat dan keceluparan yang dipamerkan oleh segelintir penduduk bukan budaya dari Pakatan Rakyat yang baru memerintah belum sampai dua tahun.(sila lihat video: https://wanitakeadilan.wordpress.com/2009/09/06/2558/)

Pendidikan rakyat adalah tanggungjawab kerajaan yang meletakkan dasar dan pengoperasian serta amalan pemimpin yang dicontohkan kepada rakyat.   Umno-BN telah gagal mendidik sebahagian Melayu sehingga menjadi Mat dan Minah pengacau dan pengganggu ketenteraman.   Sepanjang pemerhatian rakyat, Pakatan Rakyat tidak pernah menganjur aksi memalukan yang sebegitu rupa.   Ia melewati batas hak-asasi manusia untuk bersuara dengan aman.   Seluruh dunia diperlihatkan betapa sebahagian Melayu telah bersikap kekontangan nilai, adab dan tamadun – serta membawa imej pembuat kacau, penyangak dan buli dalam satu sesi dialog yang bertujuan untuk memberi peluang setiap pihak mengemukakan pandangan dan cadangan secara beradab, sopan dan dalam keadaan tenteram.

Kenyataan PM, Najib Razak sesungguhnya telah meletakkan diri beliau setaraf dengan penyangak, pembuat kacau dan buli yang beraksi amat menjengkelkan yang menjadi contoh amat buruk bagi sekelian rakyat Malaysia, khususnya generasi muda dan anak-anak.

Apakah Najib Razak akan membiarkan segolongan rakyat yang ganas perlakuannya dibiarkan tanpa sedecit muhasabah terhadap perlakuan mereka yang jelas salah dan sama sekali memalukan?

Menteri Besar Selangor Tan Sri Khalid Ibrahim adalah merupakan individu paling bijaksana di akhir sesi dialog tersebut.   Beliau telah sedayanya memberi peluang semua yang ingin menyuarakan pendapat dan mengatasi segala rintangan serta memberikan keputusan yang adil kepada semua pihak.

Bezanya Kerajaan Pakatan Rakyat dengan Umno-BN ialah mengundang isu di tangani secara komited dan tidak membiarkan masalah didiamkan dan berlarutan berdekad-dekad.   Pakatan Rakyat akan sentiasa melakukan amanah mereka dengan bersungguh-sungguh tanpa menghiraukan sebarang intimidasi dari golongan penyangak yang menjahanamkan kebaikan di mana-mana saja dan memecah-belahkan hubungan sesama manusia.  Keseluruhan masalah yang dikendalikan oleh Kerajaan Selangor Pakatan Rakyat adalah warisan dari Kerajaan Umno-BN dan agensi mereka yang telah melakukan berbagai kepincangan dalam pentadbiran dahulu, termasuk mengenai kuil Seksyen 19 yang telah menjadi isu.

1Malaysia Najib Razak merupakan kepura-puraan yang tidak dapat disangkal lagi dengan kenyataan beliau yang sempit itu.

Wanita KEADILAN menuntut Najib Razak sebagai Perdana Menteri Malaysia untuk berpemikiran lebih sihat dan memberi pertimbangan yang lebih saksama terhadap semua isu yang disentuh pada setiap masa dan keadaan.
